Keivos Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Keivos LLC ("Company," "Keivos," "we," "us," or "our"), governing your access to and use of the Keivos student application (iOS, Android, and web), the Keivos Advisor Dashboard, and all related services (collectively, the "Services"). By creating an account or using any part of our Services, you agree to be bound by these Terms and our Privacy Policy (available at www.keivos.com/privacy). If you do not agree to these Terms, do not use the Services.
2. Description of Services
Keivos is a two-part educational technology platform: (a) the Keivos student application, a mobile and web product that helps pre-medical students track academic progress, extracurricular activities, and medical school applications; and (b) the Keivos Advisor Dashboard, a web-based platform that enables university pre-health advisors to monitor and guide their students' pre-medical journeys. The Services facilitate data sharing between students and their university advisors, subject to student consent and FERPA compliance. Universities engage Keivos for institutional access through a separate University License Agreement.
3. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use our Services. By using the Services, you represent that you meet this age requirement. Our Services are designed for college and university students and educational professionals. We do not knowingly collect information from individuals under 13 years of age.
4. User Accounts
4.1 Account Creation
To access the Services, you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4.2 Student Accounts
Student accounts are individual accounts tied to a single student. Students may select their undergraduate university during onboarding and consent to share data with their university's pre-health advisor. Students retain full control over their data sharing preferences.
4.3 Advisor Accounts
Advisor accounts are institutional accounts provided to universities under a separate University License Agreement between Keivos and the partnering institution. Each license includes a base allocation of advisor seats; additional seats may be added at the rates set in the University License Agreement. The university designates an account administrator responsible for managing team access and ensuring all advisors under their account comply with FERPA and these Terms. Demonstration access for institutions evaluating the platform is available on request to partnerships@keivos.com.
5. Subscriptions and Payments
5.1 Student Application
The Keivos student application offers a seven (7)-day free trial followed by one-time lifetime access purchase options. Current pricing is displayed within the app at the time of purchase and may include promotional rates from time to time. iOS purchases are processed through Apple's In-App Purchase system and are subject to Apple's terms and refund policies. Android and web purchases are processed through Stripe and are subject to the refund terms in Section 5.3. Pricing displayed inside the Apple App Store and the Google Play Store will at all times control for the purchase channel through which you are paying.
5.2 University License Agreement
Universities engage Keivos for institutional access through a separate University License Agreement, which establishes pricing, contract term, advisor seat allocation, onboarding services, and any pilot program participation. The University License Agreement template and current institutional pricing are available on request from license@keivos.com. Student access provided through a University License is at no individual cost to the student for the duration of the license, regardless of the student's prior or subsequent individual subscription status.
5.3 Refunds
For student application purchases made through Apple's App Store, refund requests must be directed to Apple in accordance with Apple's refund policies. For Android and web purchases processed through Stripe, refund requests may be submitted to support@keivos.com within thirty (30) days of initial purchase; no refunds are issued after the 30-day period. For University License Agreements, refund terms are governed by the cancellation and termination provisions of that agreement.
6. Data Sharing, Privacy, and FERPA
Our data practices are governed by our Privacy Policy at www.keivos.com/privacy. Key commitments include:
- Student data is shared with advisors ONLY with explicit student consent
- Students may revoke consent at any time, immediately stopping data sharing
- We comply with FERPA, CCPA/CPRA, SOPIPA, and applicable state privacy laws
- We do not sell, rent, or share student data with third parties for commercial purposes
- We do not serve advertisements or use student data for targeted marketing
- All data is encrypted in transit and at rest using industry-standard encryption
- Advisors may only access data for students at their own university
Universities partnering with Keivos enter into a Data Processing Agreement (DPA) establishing specific data handling obligations. The DPA template is available at www.keivos.com/dpa. The current list of all sub-processors we use is available at www.keivos.com/subprocessors.
7. Acceptable Use
You agree not to:
- Access or attempt to access another user's account without authorization
- Use the Services to harass, threaten, or send inappropriate messages
- Share your login credentials with others
- Attempt to circumvent security measures or access controls
- Use the Services for any purpose other than their intended educational use
- Scrape, harvest, or collect data from the Services through automated means
- Misrepresent your identity, university affiliation, or role
- Upload false academic data with the intent to deceive advisors or institutions
We reserve the right to suspend or terminate accounts that violate these provisions.
8. Messaging and User-Generated Content
The Services include messaging features that allow students and advisors to communicate. All messages are subject to our acceptable use policy. Users may report inappropriate content or block other users. We reserve the right to review messages in response to reports of abuse or to comply with legal obligations. We do not routinely monitor message content.
9. Intellectual Property
All content, features, and functionality of the Services — including software, text, graphics, logos, the KEIVOS name and word mark, and the King Score and underlying scoring algorithms — are owned by Keivos LLC and are protected by United States and international intellectual property laws. You retain ownership of any data you input into the Services (academic records, activity descriptions, messages).
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE ADMISSION TO ANY MEDICAL SCHOOL OR EDUCATIONAL INSTITUTION. THE KING SCORE AND ANY RECOMMENDATIONS ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE PROFESSIONAL ACADEMIC ADVISING.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEIVOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Keivos LLC, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms or for any reason with reasonable notice. You may terminate your account at any time by using the account deletion feature in the app or by contacting us. Upon termination, your right to use the Services ceases immediately. Data deletion upon termination is governed by our Privacy Policy and data retention schedule.
14. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Utah without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures. The arbitration shall take place in Salt Lake City, Utah. Either party may seek injunctive relief in a court of competent jurisdiction. To the maximum extent permitted by law, each party waives any right to a trial by jury and waives any right to participate in a class, consolidated, or representative action against the other party.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through in-app notification or email at least 30 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
